The following guidelines apply to anyone that chooses to work with MNR.
Written February 17th, 2007
Updated July 30th, 2007
Midwest Nailgun Records [henceforth referred to as "MNR"] reserves the right to change or modify any of the conditions, rules and/or guidelines [i.e. release dates, artwork design, selected track - any element of any project] without the consent [written or otherwise] of any party involved either directly or indirectly with MNR as a result of unforeseen circumstances. MNR reserves this right to change any detail at their discretion; although nothing will be changed unless MNR feels it to be absolutely necessary and/or in the best interest of the project at hand.
Any band that would like to participate in an upcoming compilation, project, promotion, etc. [henceforth simply referred to as "project"] is required to pay 1/4 of their total cost [unless a different amount is specified] as a safety deposit to reserve a slot within that particular project. This deposit will ultimately be subtracted from their total cost, but is non-refundable if a band fails to follow through with their monetary and material obligations. Upon initiation of work with MNR, and payment of said safety deposit you agree to these [and the following] terms.

Guidelines for Signed Bands:
All signed bands will have separate, specific contracts. The following guidelines still apply, but said contracts may modify certain aspects.
When working with MNR, all parties simultaneously agree to the following:
1. MNR has the right to use the specified track[s] [agreed upon prior to complete payment] on the specific project in question regardless of copyright laws. MNR DOES NOT GAIN OWNERSHIP OF THIS MUSIC, but they are granted the right to use it as they see fit [on said project]. By paying for a slot, you agree to this and the following.
2. The specified track WILL NOT BE USED on any other MNR CD [project] without the consent of the artist. However, tracks and band logos, pictures, and/or information may be used for advertisement [i.e. web .mp3 players, sample discs, etc] and promotional use at the discretion of MNR. At no point will extended royalties be distributed.
3. Any project produced will not be re-pressed without the consent of all parties involved. However, if contact cannot be made with a band after numerous attempts OR if a band has broken up OR if a band fails to respond within 7 days, MNR reserves the right to decide whether or not to continue with a re-press.
4. Specific details about each project will be provided upon request/initial contact. However, the details of said project[s] may also change without the knowledge or consent of all parties involved.
5. If a band receives a cut of the CDs produced from any project and decides to sell said units, they may do so. Bands are NOT REQUIRED to split any revenue gained via individual CD sales with MNR. However, bands are NOT ALLOWED to illegally duplicate and sell any MNR CD without the full written consent of MNR, regardless of their level of participation.
6. Of the CDs produced for each project, a certain number may be distributed to the bands. The remaining CDs are the property of MNR to be sold via their website[s] or any other medium. As previously stated, no extended royalties will be distributed from subsequent sales.
7. MNR reserves the right to sell compilation disc[s] as well as individual tracks through online digital retail outlets. As previously stated, no extended royalties will be distributed from subsequent sales.
8. If a band does not meet a project[s] deadline [for materials or monetary responsibilities] they may be removed from that project. They will be notified but receive NO compensation [refund], since they have failed to uphold their previously agreed upon responsibilities. Any and all funds or material received will not be returned and will concurrently become the property of MNR.
9. Any image and/or information [logo, images, written bio, etc.] provided by any band/individual may be edited at the discretion of MNR. This applies but is not limited to images and information used in advertisement, within projects, and on the MNR website.
10. MNR will provide no refunds and/or compensation for problems due to incorrect shipping addresses. Sent addresses [email] are copied over directly to shipping labels as they are received, and their correct notation is the responsibility of each participant.
11. By agreeing to work with MNR, you simultaneously agree to the preceding stipulations.
